What is it?
This decree-law creates special and temporary rules to respond to the COVID-19 disease pandemic in the cultural sphere, especially with regard to shows not held at the venue, date and time previously scheduled.
Given the public health emergency of international scope, declared by the World Health Organization on 30 January 2020, as well as the classification, on 11 March 2020, of the COVID-19 disease as a pandemic, the Government has been approving a set of extraordinary and urgent measures, in several matters.
What is going to change?
The shows that cannot be held at the scheduled place, day and time, between 28 February 2020 and the 90th business day following the end of the state of emergency, should be rescheduled whenever possible.
Rescheduling of the show
The show must take place within one year from the date initially scheduled.
Entities selling tickets may not charge fees to cultural agents for the performances not held.
If the show is rescheduled, no additional fee may be charged to the event promoter.
Cancellation of the show
In this case, the place, physical and electronic, mode and deadline for returning the price of tickets already purchased must be indicated.
The amount paid for the room or venue reservation must be returned to the event promoter.
Shows rescheduled or cancelled by public entities
In the event of rescheduling, public authorities may:
- modify existing contracts;
- advance the price without legal limit;
- review the price;
- contract complementary works.
In case the show is cancelled, the public entities must pay the cultural agents for part of the services and works already performed.
What advantages does it bring?
This diploma guarantees the protection and sustainability of cultural agents who promoted the shows not performed, due to the pandemic, as well as the right of consumers who had already purchased tickets for those shows.
When does it enter into force?
This decree-law enters into force on the day following its publication.
