What is it?
This decree-law creates three new special careers in the Criminal Police (PJ).
It also establishes the professional status of the PJ’s employees.
What is going to change?
Three new special careers in the PJ are created:
- Criminal investigation career;
- Scientific police expert career;
- Security guard career;
The scientific police expert and security guard careers are special careers for the support to criminal investigation.
The employees of the special careers cannot exercise another professional activity, with the exception of the teaching or investigation activity, subsequent to an authorization.
The enrolment in the special careers is carried out through a specific public tender (regulated by an administrative decree by the government members responsible for the finances, internal administration and justice areas).
After the recruitment of the special careers’ employees, a trial period starts, which lasts for one year on the criminal investigation career and nine months on the other special careers.
Upon a successful completion of the trial period, the special careers’ employees must remain in service in PJ for, at least, five years.
The legal public employment relationships of the special career’s employees are constituted by appointment.
The special careers’ employees are subject to the general remuneration scheme of the employees who exercise public functions.
Transition to the availability situation
The criminal investigation career’s employee automatically transitions when reaching 60 years of age or through an order by the government member responsible for the justice area, upon request by the interested party, when reaching 55 years of age or 36 years of service.
What advantages does it bring?
By establishing the professional status of the PJ’s employees and by creating new special careers, the role of these employees is valued and recognized on the functions they perform and which are essential to comply with the PJ’s mission - fight violent, highly organized and complex crimes (including economical-financial criminality).
When does it enter into force?
This decree-law enters into force on 1 January 2020.
