What is it?

This decree-law introduces the European Directive 2009/33/CE into the Portuguese law. The directive promotes the use of ‘environmentally friendly’ cars, buses, coaches and trucks.

What will change?

When launching a public tender to purchase or lease one of these vehicles all public entities must consider the vehicle’s:

  • energy consumption
  • CO2 emissions (CO2 is one of the gases responsible for global warming and the greenhouse effect)
  • pollution emissions.

When assessing the alternatives proposed, public entities must take into account not only the price of the vehicle but also the impact of energy consumption and pollution emissions on the lifetime costs of the vehicle.

Entities that must comply with these rules

These rules apply to:

  • government entities (the State, local authorities, public institutes, public foundations, public associations and others)
  • entities that supply public transportation services, but only when the purchase or leasing contract is worth more than 499 000 euros.

Vehicles not covered by these rules

These rules do not apply to purchase or leasing contracts of:

  • vehicles built to be used on work sites, quarries, ports and airports
  • vehicles built to be used by armed forces, civil protection, firefighters and police
  • mobile machinery.

What are its benefits?

This decree-law is intended to:

  • encourage public entities to buy or lease more efficient vehicles
  • promote the use of renewable energies
  • reduce fossil fuel imports (made from coal, petroleum and natural gas)
  • lower emissions of greenhouse gases and other pollutants.

When does it come into effect? 

This decree-law comes into effect five days after being published.
