What is it?

This decree-law promotes the gradual return of the operation of public and private services.

Given the public health emergency of international scope, declared by the World Health Organization on 30 January 2020, as well as the classification, on 11 March 2020, of the COVID-19 disease as a pandemic, the Government has been approving a set of extraordinary and urgent measures in several matters.

What is going to change?

Rules are implemented that ensure the gradual return of the operation of public services or the way in which expired official documents that could not, however, be renewed in view of the context experienced, as well as ensuring that the competent authorities continue to be able to maintain the careful respect for workers' rights.

The use of masks or visors is now compulsory for access to or permanence in the workplace:

    • spaces and commercial and service establishments;
    • services and buildings serving the public;
    • educational establishments and nurseries by teaching and non-teaching staff and students over the age of 6;
    • public passenger transport.

In public transport, daily cleaning, weekly disinfection and monthly hygiene of vehicles, facilities and equipment used by passengers and other users should be ensured.

Catering and beverages establishments may open, but with occupation rules to be defined.

In the current context of the COVID-19 disease, and exclusively for reasons of health protection of the employee and third parties, body temperature measurements may be taken to workers for the purpose of access and permanence in the workplace.

If the worker has a higher than normal temperature, that person's access to the workplace may be prevented.

A special protection scheme is also established for chronically ill or immunosuppressed persons, who are considered to be at risk, who may be absent from work upon medical declaration, except when they are workers in essential public services or may work in another way or teleworking.

The possibility of using social equipment is also created and simplified lay off is also allowed to companies, with financial support.

On the other hand, the powers and means of the Authority for Working Conditions are reinforced and companies have to create contingency plans appropriate to the workplace.

Funeral homes maintain the services and carry out the same for the dead of COVID-19.

The military in the reserve can still be called into service until the end of this year.

The public services take similar measures to companies and keep employees teleworking.

The presentation of the physical complaints book remains suspended.

What advantages does it bring?

This decree-law allows for the gradual return of the operation of public and private establishments.

When does it enter into force?

This decree-law enters into force on the day following its publication.
