What is it?

The Member-States of the European Union are bound to maintain a minimum level of crude oil and/or oil products reserves and to avoid the scarcity of such products.

This decree-law amends the regulation of the oil products safety reserves, transposing the European rules regarding the calculation methods of the storage and safety reserves obligations in the European Union.

What is going to change?

New mechanisms are created to facilitate, to the operators, the report of information on the oil and oil products safety reserves, and to allow a more efficient and quicker control of the reserves’ location and physical conditions.

The obligations and report periods of the operators, specially of the new operators, regarding the energy sector’s regulatory entity (ENSE, E.P.E. - National Entity for the Energy Sector), are altered.

Until the last business day of each month, the operators must provide the information regarding the reserves for the following month.

For the report to which the operators are bound, the ENSE’s online one-stop desk may now be used.

The new operators are now covered by fines envisaged for the non-compliance with the information obligations.

The method to measure the net imports to be considered for counting purposes of the obligation to constitute and maintain safety reserves is altered.

The period from 1 January to 30 June of each civil year is now considered and the benchmark net imports are the ones of the civil year before that same year.

To calculate the minimum quantities of the bound operators’ safety reserves, the same temporary criterion is now used.

What advantages does it bring?

It aims to improve the control system of the oil and oil products reserves’ location and physical conditions in the country and to respond in the case of severe disturbance of these products’ supply.

When does it enter into force?

This decree-law enters into force on 1 January 2020.
