What is it?

This decree-law introduces, on the Portuguese law, the European directive 2016/2284 EU on the reduction of national emissions of certain air pollutants, and updates the rules regarding the air pollution control:

    • in Portugal (continent)
    • on the exclusive economic zone
    • on the pollution control zones.

The exclusive economic zone is a strip of sea with 200 nautical miles (about 370 kilometres). On this strip, Portugal has priority on the use of natural resources and is responsible for the environmental protection.

The pollution control zones are strips of sea with an extent equal or lower than the exclusive economic zone, which are defined to prevent, reduce and control the pollution caused by ships, accordingly to the applicable international rules.

What is going to change?

1. Portugal undertakes to comply with, until 2020 and 2030, certain maximum emission limits for:

    • sulphur dioxide (SO2)
    • nitrogen oxide (NOx)
    • non-metallic volatile organic compounds (NMVOC) (for instance, substances issued by the exhausts of vehicles with a combustion engine)
    • ammonia (NH3)
    • fine particles (PM2.5).

2. The creation of the National Programme of Air Pollution Control by the Government is envisaged, in harmony with the National Air Strategy (ENAR2020), which integrates a Code of Good Agricultural Practices to reduce ammonia emissions.

The effects of air pollution on the earth and water ecosystems are now monitored and informed to the European Commission.

3. To ensure Portugal’s compliance with the obligations provided by the European Union’s law on this matter, the following entities are involved:

    • Portuguese Environment Agency (APA)
    • National Institute of Agricultural and Veterinary Research (INIAV)
    • General-Directorate of Agriculture and Rural Development (DGADR)
    • Planning, Policies and General Administration Office (GPP)
    • Institute of Nature and Forests Conservation (ICNF)
    • Regional Coordination and Development Committees (CCDR)
    • the Portuguese (continent) municipalities

What advantages does it bring?

This decree-law aims to reduce the emissions of certain air pollutants, updating the national rules and harmonizing them with the European Union rules.

When does it enter into force?

This decree-law enters into force 5 days following its publication.
