What is it?

This decree-law amends the price revision scheme for public and private works contracts and for the acquisition of goods and services.

What is going to change?

In the case of omission in the specifications or if they consider the specifications to be inadequate to the specifics of the contract, interested parties may present the price revision formula within the first third of the deadline for the submission of tenders.

Likewise, the possibility of revision by cost guarantee continues to be provided for, a fact that has to do with the technological evolution in the construction sector, which results in new construction solutions and new professional categories, a situation to which revision by formulas may be less adjusted.

Finally, the updating of the price revision indexes is no longer subject to approval by the member of the Government responsible for the area of infrastructures, but is now approved by the board of directors of the Instituto dos Mercados Públicos do Imobiliário e da Construção (Institute of Public Markets for Real Estate and Construction).

What advantages does it bring?

This decree-law adapts and reconciles the price revision scheme with the provisions of the Public Contracts Code.

When does it enter into force?

This decree-law enters into force on 16 October 2021.
