This decree-law creates the Consular Regulation.What is going to change?
A New Consular Management Model (NMGC) is implemented, which adopts measures to strengthen the simplification of administrative activity in consular posts, as well as the dematerialization of consular acts and procedures.
To this end, IT platforms are created that enable the practice of consular acts and their payment by electronic means.
Contact between Portuguese citizens and consular offices is promoted through the practice of acts by electronic means and digital channels accessible to everyone.
The concepts of provision of assistance and repatriation have been clarified.
Assistance is provided in cases of proven temporary need, through a statement by the assisted person undertaking to reimburse the state for the cost of the respective expenses (which may include food, transport, accommodation or medicine).
Repatriation provides for the return of a person of Portuguese nationality or of a European Union Member State to his/her country of nationality, if requested. It may occur in two situations:
- Proven lack of means to bear the costs of return;
- Medical reasons which advise the immediate return of a sick person, due to the impossibility of local treatment.
In order to ensure greater consular protection, the concept of emergency situation has also been redefined: it occurs when we face an abnormal and serious situation of temporary nature, such as, for example, a road accident or a natural disaster.What advantages does it bring?
This decree-law aims to adapt the consular organisation to the new realities and needs of Portuguese emigration and Portuguese communities by simplifying procedures and consolidating the support mechanisms for emergency situations.When does it enter into force?
This decree-law enters into force on 1 September 2021.
