Summary in plain english

What is it?

This decree-law establishes:

    • The sanctions framework applicable to the breach of the rules on cross-border parcel delivery services provided for in Regulation (EU) No. 2018/644.
What is going to change?

The following are now administrative offences:

    • Breach of information duties;
    • Failure to comply with information requirements that are imposed;
    • Breach of the duty of cross-border service providers to provide information to the National Regulatory Authority on their tariffs by 31 January of each calendar year.
    • Failure to communicate to the National Regulatory Authority, within one month of receiving the National Regulatory Authority's request, the evidence and justification of the tariffs that will enable it to assess them;
    • Breach of the duty to make pre-contractual information available to consumers, by traders who conclude purchase and sale agreements that include the cross-border sending of orders, on the delivery options and charges payable by the consumer and, where applicable, their complaint handling policies.
What advantages does it bring?

This decree-law makes it possible to make effective, through the adoption of proportionate and dissuasive sanctions, the application of the rules of Regulation (EU) No. 2018/644 which have already been in force in the European Union since November 2019.

When does it enter into force?

This decree-law enters into force on 15 June 2021.
