This decree-law amends the protection scheme in case of invalidity and old age for the beneficiaries of the general social security scheme.What is going to change?
The communication by the pension management body to the beneficiary informing them that the pension will be granted if, within 30 days of the communication, the beneficiary does not expressly withdraw their request for an early pension, is eliminated.
The beneficiary may withdraw the request for a pension within 15 days of the communication of the award of the pension.
It is compulsory to assess the disability of the beneficiary of an absolute invalidity pension in situations where the invalidity pension is combined with income from work.
Provisional invalidity or old age pensions can now be granted automatically, based on the information in the social security information system.
The social security electronic notification system can be used in situations where the request is submitted through segurança social direta (direct social security).
System for changing contribution periods
The relevant calendar years for the guarantee period and other conditions of access to the pension, as well as the annual remunerations considered for the calculation of the pension, are consolidated after 10 years from the date of approval.
The annual update of the Social Support Index is suspended, whenever it is negative.What advantages does it bring?
This decree-law ensures faster action by social security in the payment of pensions, materializing the Simplex project "Pensions on the Spot".
It guarantees the protection of the beneficiaries of social benefits.
By providing for its automatic attribution, this decree-law avoids delays in the payment of pensions.When does it enter into force?
This decree-law enters into force on the day following its publication.
