Summary in plain english
This decree-law establishes the rules to be applied to immovable property in the private domain of the State and of public institutes located abroad, as well as to immovable property affected or to be affected to other States or to international organizations.
What is going to change?An exceptional scheme is created that regularises the mechanisms necessary to formalise a set of consolidated situations over time, thus allowing a better distribution of public real estate between public institutions, without resorting to additional conditions the registry situation of a set of concrete situations, many of them since the 1970s, which cannot be administratively managed, thus creating:
- the terms of regularisation and construction of the assets of higher education institutions, according to a logic of cost reduction and the adoption of economically viable alternatives;
- a set of rules applicable to buildings in the private domain of the State that have been transferred to the assets of public higher education institutions and that have, in the meantime, ceased to be necessary for the performance of their respective tasks and competences.
This decree-law seeks to make it easier to set up and close annually the offices of State entities abroad, while respecting the provisions of international law applicable to relations between States, between States and international organisations, as well as to public assets located abroad.
When does it enter into force?This decree-law enters into force on 12 January 2021.
