What is it?

This decree-law establishes the rules and procedures to be adopted by the Institute for the Financing of Agriculture and Fisheries (IFAP) in the process of delegating the tasks and powers necessary for the implementation of the function of payment of aid and financial support, in particular under the European Agricultural Guarantee Fund and the European Agricultural Fund for Rural Development.

What is going to change?

The protocols for the delegation of tasks between IFAP and the delegated bodies were agreed and approved by the member of the government responsible and expired in 2020.

There is therefore a need to conclude new protocols which should establish a set of requirements for the tasks to be delegated. In this context, an exceptional scheme is established to allow delegations of powers and tasks that are in force to remain valid and in execution during the transitional period, until the European regulations applicable to this programming period are published, avoiding time gaps in the implementation of the Strategic Plans of the Common Agricultural Policy (CAP), which cause disruptions to the convergence dynamics of the Portuguese economy.

The Protocols may exceptionally be extended until the entry into force of the European regulations applicable to the new period, up to a maximum of one year, when the end of the period falls in the last six months before the end of a programming period of the CAP or during the respective transitional period and the European regulations applicable to the new period have not been published.

The financial burden arising from the Protocols is covered by appropriations to be entered in the budget of the IFAP, its framework being ensured within the framework of technical assistance co-financed by the FEADER, within the limits and conditions laid down in the relevant Community regulations.

What advantages does it bring?

This decree-law establishes an exceptional scheme allowing delegations of powers and tasks to remain valid and in force during the transitional period.

When does it enter into force?

This decree-law entered into force on the day following its publication and takes effect from 31 December 2020.
