What is it?

This decree-law defines the requirements applicable to the design and renovation of buildings in order to ensure and promote the improvement of their energy performance by setting requirements for their modernisation and renovation.

It regulates the Energy Certification System for Buildings (SCE).

What is going to change?

Technical systems of buildings

Technical systems, such as air conditioning (heating and cooling) of rooms or ventilation of buildings covered must meet requirements and rules for installation, maintenance, performance documentation, periodic assessment and monitoring of consumption and periodic inspections.

Requirements to be met by buildings

New buildings must be buildings with almost zero energy requirements and are therefore required to meet requirements to achieve high levels of energy performance.

These are minimum energy performance requirements, which aim to minimise the occurrence of pathologies and limit energy needs, and requirements for technical systems.

The requirements relating to technical systems focus on several factors, such as for example:

    • General energy performance;
    • Appropriate sizing;
    • Correct installation;
    • Appropriate control.

The fulfilment of these requirements is ensured, as a rule, by the technical authors of the projects.

New buildings must also comply with specific requirements regarding thermal comfort and energy performance, to be ensured by qualified experts of the SCE.

New buildings are also subject to requirements related to space ventilation, in order to ensure adequate air filtering and renovation.

Buildings subject to renovation

Renovated components and buildings undergoing major renovation must meet the same requirements as new buildings, with a view to transforming them into buildings with almost zero energy requirements, according to their typology as residential buildings or commercial and service buildings and taking into account the interventions concerned.

Periodic assessments and monitoring of energy consumption of buildings

Certain buildings are subject to periodic evaluations and annual monitoring of their consumption as they have to maintain a minimum level of energy performance.

Building automation and control systems (SACE)

Automation and control systems are foreseen for buildings with higher energy needs, taking into account their potential for more rational energy consumption.

SACEs are systems that encompass all products, software and engineering services that contribute to the economic, safe and energy-efficient operation of the building's technical system through automatic controls and easy manual management.

Automation systems should ensure the continuous and comparative monitoring, recording and analysis of energy consumption and energy efficiency of buildings in order to obtain information about their actual or potential energy performance, as well as communication and interaction between all technical systems, regardless of their differences.

Apart from certain situations, commercial and service buildings that have certain technical systems with a specific global rating must install SACEs by 31 December 2025.

Electrical mobility

The installation of electric vehicle charging points in car parks is planned according to the typology of the respective buildings, as well as their location and number of available spaces.

Apart from certain situations, commercial and service buildings with more than 20 spaces must have two electric vehicle charging points by 31 December 2024.

Periodic inspections

In the context of technical heating, cooling or ventilation systems, periodic inspections are planned in order to reliably assess performance and identify any measures to be taken to improve it.

Support for building renovation

The members of the government responsible for finance and energy can establish financial measures and incentives for the renovation of buildings.

These measures and incentives depend on the energy savings achieved in order to improve the energy performance of buildings in particular:

    • Improvements achieved through renovation (comparing energy certificates issued before and after renovation);
    • Energy performance of equipment used for renovation.
What advantages does it bring?

By establishing the requirements for the design and renovation of buildings, this decree-law ensures and promotes the improvement of their energy performance, ensuring greater energy efficiency.

It contributes to the development of a sustainable, efficient and safe energy system.

Compliance with the requirements and rules applicable to the technical systems and/or buildings covered will enable the identification of opportunities and measures to improve their energy consumption and performance.

When does it enter into force?

This decree-law enters into force the day after its publication, with the exception of Chapters II, III and IV and the repeal rule which take effect on 1 July 2021.
