Summary in plain english
This decree-law amends two schemes. They are:
1 - The scheme that extends the extraordinary support for maintaining employment contracts in business crisis and creates other employment protection measures under the Economic and Social Stabilisation Programme;
2 - The scheme that creates extraordinary support for the gradual resumption of activity in companies in a situation of business crisis with a temporary reduction of the normal working period.
Given the public health emergency of international scope, declared by the World Health Organization on 30 January 2020, as well as the classification, on 11 March 2020, of the COVID-19 disease as a pandemic, the Government has been approving a set of extraordinary and urgent measures in several matters.What is going to change?
The employer that, until 31 October 2020, has requested the extraordinary incentive to the normalization of the business activity may give up that support and join the extraordinary support for the progressive resumption of activity in companies in a business crisis situation with a temporary reduction of the normal working period, without having to return the amounts already received.
The employer that has used the reduction or suspension measures foreseen in the Labour Code, and that wishes to access the support foreseen in the present decree-law, is not subject to the time limit that limits the use of reduction or suspension measures.What advantages does it bring?
This decree-law aims to ensure the normal functioning of the business activity by maintaining jobs.When does it enter into force?
This decree-law enters into force on the day following its publication.
