What is it?

This decree-law temporarily and exceptionally shortens the guarantee periods for access to unemployment benefits, for termination of activity and for termination of professional activity.

On the other hand, it determines the temporary suspension of the exclusivity scheme when the single amount of unemployment benefits is applied.

Given the public health emergency of international scope, declared by the World Health Organization on 30 January 2020, as well as the classification, on 11 March 2020, of the COVID-19 disease as a pandemic, the Government has been approving a set of extraordinary and urgent measures in several matters.

What is going to change?

The temporary and exceptional reduction of the guarantee periods for access to unemployment benefits, for termination of activity and for termination of professional activity, is being implemented through the adequacy of the formula for calculating the reference remuneration.

The exclusivity scheme is temporarily suspended when the single amount of unemployment benefit is applied. In other words, in situations where the job itself is created with recourse to the overall amount of unemployment benefits, the impediment to the accumulation of the exercise of the activity with another normally remunerated activity is suspended.

This suspension may not exceed 12 months and must be requested from the competent employment service, together with the reasons for the suspension.

The suspension applies to situations occurring between 1 April and 31 December 2020, and this period may be extended.

In the period in which there is an accumulation of activity, this is not taken into account for the purposes of counting the three years in which beneficiaries are obliged to maintain the employment created using the overall amount of unemployment benefits.

What advantages does it bring?

This decree-law safeguards situations of job creation using the amount of unemployment benefits, and in the current context of recovery from the period of confinement, the interruption of the development of activity will have motivated or aggravated these situations.

When does it enter into force?

This decree-law comes into force on the day following its publication, article 2 takes effect on 25 July 2020, and article 1 takes effect on 1 April 2020.
