What is it?

This decree-law establishes an exceptional scheme for the constitution of legal employment relationships of open-ended or indefinite duration in bodies, organisms, services and other entities, including the public business sector of the Ministry of Health, for the direct provision of health care and support services.

Given the public health emergency of international scope, declared by the World Health Organization on 30 January 2020, as well as the classification, on 11 March 2020, of the COVID-19 disease as a pandemic, the Government has been approving a set of extraordinary and urgent measures in several matters.

What is going to change?

Are converted into open-ended employment contracts the contracts that have been signed by entities of the corporate public sector of the Ministry of Health, under the exceptional scheme of fixed-term contracts approved under the measures to combat the pandemic.

The conversion of contracts is authorised by order of the member of the Government responsible for the health area, on the basis of a duly substantiated proposal from the highest management body.

Employment contracts in public functions for an indefinite period are also signed with workers who, on the date of entry into force, are in the exercise of functions in the bodies, agencies, services and other entities of the Ministry of Health.

The contracts are entered into after a tender procedure, to which other workers with and without a previously constituted public employment relationship may apply.

The opening of the tender procedures is authorised by the member of the Government responsible for the health area, within a maximum of 30 days from the survey of the permanent needs of the entities, bodies, and services.

What advantages does it bring?

This decree-law promotes the improvement of working conditions in the National Health Service (SNS), establishing an exceptional scheme of open-ended and indefinite contracting of health professionals.

When does it enter into force?

This decree-law entered into force on 17 October 2020.
