What is it?

This decree-law redefines the structure and organisation of the Ministry of Justice (MJ).

What will change?

The MJ’s services and other related bodies are being combined.

The merger of existing bodies reduces management positions and cuts costs by preventing overlapping tasks.

New focus on alternative resolutions to disputes

The Office for Alternative Resolutions to Disputes will become part of the Directorate-General for Judicial Policy. This body aims to create procedures that may settle disputes without going to court.

Directorate-General for Social Reintegration and Prison Services is created

This new body replaces the former Directorate-General for Social Reintegration and the Directorate-General for Prison Services, which will no longer exist.

Institute of Financial Management and Resources for Justice is created

This new institute is formed by merging the Institute of Information Technology for Justice and the Institute of Financial and Infrastructure Management of Justice.

The new institute will receive the Justice Modernisation Fund, which was created in 2011 and was managed by the former Institute of Financial Management and Infrastructure of Justice.

Institute of Forensic Medicine changes name

This institute will now be called the Institute of Forensic Medicine and Science and will be granted more autonomy (specifically in the administration of forensic offices).

This State-owned laboratory will also be responsible for managing a database of genetic profiles (DNA).

Controlling the activity of bankruptcy administrators

The Commission for Supervision and Control of Bankruptcy Administrator’s Activity is created. It will be responsible for licensing their profession and monitoring their actions.

Specific legislation will be passed to regulate the commission’s operation.

Extinction of the financial controller post

The MDN will no longer have an in-house financial controller. This position was created in 2006 to oversee financial management in each ministry, but this model is now being replaced.

What are its benefits?

This decree-law is intended to:

  • increase efficiency in use of public resources
  • reduce State expenses
  • promote alternative ways of settling disputes outside courts of law.
When does it come into effect?

This decree-law comes into effect five days after being published.
