Summary in plain english
This decree-law amends the rules on penalties applicable to the legal schemes of the Single European Sky and lays down the technical requirements and procedures for air traffic controllers' licences and certificates.
What is going to change?The Maritime Accidents Investigation Office and the Meteorological Authority (GAMA) is included as the competent authority in the field of civil aeronautical meteorology surveillance to oversee and monitor compliance with the Single European Sky legal scheme in the civil aeronautical meteorology part.
Updating of offences
The system of civil aviation offences is updated.
The sanctions framework for failure to comply with technical requirements and administrative procedures for air traffic controllers' licences and certificates is introduced.
ANAC is responsible for decision on the possible authorisation of flight information service providers to declare their capability and means to assume the responsibilities related to the services provided.
The possibility for Member States to decide to include in the cost base of route and terminal charges all other costs incurred in the provision of air navigation services is defined.
Proceeds of fines in aviation meteorology cases initiated by GAMA
The 30% of the fines imposed, foreseen for the National Civil Aviation Authority, reverts to the GAMA, to which a further 10% may be added in situations where the same Authority has been the intervening supervisory body.
Until the revision of the charging system applicable to the route charges due by the users of the route facilities and air navigation service, the full cost recovery model is applied.
What advantages does it bring?This decree-law accompanies European legislation on the sanctions framework applicable to the legal system of the Single European Sky and on European rules for air traffic controller licences and certain certificates.
When does it enter into force?This decree-law enters into force on 6 November 2020.
