What is it?

This decree-law regulates the carrying out of the inventory of the State's real estate assets with housing suitability and creates a State property exchange for housing, within the scope of the Economic and Social Stabilisation Programme and in development of the Basic Housing Law.

What is going to change? Inventory of the State's real estate assets, for housing purposes

The Institute for Housing and Urban Rehabilitation (IHRU) is responsible for carrying out the inventory.

The inventory includes the properties belonging to the public real estate, as well as those that are vacant or available, including land.

In the preparation of the inventory, the IHRU, the Directorate-General for the Treasury and Finance, the Tax and Customs Authority, the Registries and Notary Institute, the bodies of the indirect administration of the State (public institutes, for example), municipalities and parishes cooperate.

The IHRU produces an annual report with the periodic update of the inventory.

State Property Exchange

A property exchange is set up consisting of:

    • IHRU housing estate (land and real estate acquired, transferred or rented for housing);
    • Properties that are vacant or available, identified (by the IHRU) in the inventory as being fit for housing purposes.

The management of the real estate on the exchange is done by the IHRU.

The real estate included in the exchange may be excluded from it, by order of the Prime Minister.

That exclusion gives rise to compensation by the State to the IHRU for the costs it has incurred in the management and development of the property.

What advantages does it bring?

This decree-law, when carrying out an inventory of the State's real estate assets, allows for the survey, identification, and quantification of the State's real estate for housing.

The creation of the property exchange will strengthen public housing supply, thus guaranteeing the right to housing.

When does it enter into force?

This decree-law enters into force on 3 October 2020.
