Summary in plain english
This decree-law adapts the instruments created under the New Generation of Housing Policies and the Organic Law of the Institute for Urban Housing and Rehabilitation (IHRU), to the basic law on housing and to the measures foreseen for the housing area in the Economic and Social Stabilisation Programme.
What is going to change?This decree-law adapts the following housing programmes to the Basic Law on Housing:
- 1º Direito (1st Right) - Housing Access Support Programme;
- Porta de Entrada (Gateway) - Urgent Housing Support Programme;
- Accessible Rental Programme;
- Organic Law of the Institute for Urban Housing and Rehabilitation.
The IHRU is the promoter of the national housing policy. It has administrative and financial autonomy and its own assets.
The rules for the execution of works in common parts of condominiums are simplified, requiring only notification to the condominium administrator.
If one of the tenants is a public body with powers in the area of housing management, the necessary works on the common parts can be determined and promoted by that body and the notifications are sent to the municipal councils.
In urban planning operations carried out in implementation of a Local Housing Strategy, a Municipal Housing Charter or real estate that is part of the Housing Stock Exchange, a lower number of parking spaces per place than is provided for in the regulations is permitted, provided that the satisfaction of collective needs, quality of life and quality of urban space is guaranteed and is duly authorised by the city council.
What advantages does it bring?This decree-law makes it possible to guarantee that the most vulnerable and those at risk (whether due to economic situation or age) have access to a housing response, guaranteeing the effective exercise of the right to housing for all.
It promotes simplification and speed in the promotion of public housing, guaranteeing the satisfaction of collective needs, the quality of life and the quality of urban space, promoting sustainable environmental practices.
When does it enter into force?This decree-law entered into force on 2 November 2020.
