Summary in plain english

What is it?

This decree-law ensures the implementation, in the national legal system, of the European obligations related to ship recycling and guarantees its fulfilment through inspection and surveillance actions by the Port State entities.

What is going to change?

This decree-law is applicable to ships flying the Portuguese flag, with a total internal volume of 500 tons or more, and to ships from a third country, as well as to ship recycling yards located in national territory.

The competent authorities are designated for ship surveys, for issuing certificates, for licensing ship recycling facilities and for inspections and waste management operations at these facilities.

This decree-law classifies breaches and their respective sanctions.

A technical monitoring committee is created to pronounce itself on important matters in ship recycling and to promote actions among several entities.

What advantages does it bring?

This decree-law aims to prevent and eliminate accidents and injuries to human health and the environment caused by ship recycling.

It also aims to strengthen the health of the marine environment throughout the life of ships, in order to ensure that hazardous materials coming from their recycling are managed in an environmentally friendly way.

When does it enter into force?

This decree-law enters into force on 15 September 2020.
