Summary in plain english

What is it?

This decree-law establishes the authorisation process for the construction and commissioning of cableway installations in national territory.

What is going to change?

An authorisation and safety subsystem, produced by a European Union manufacturer, are applied to new cableway installations.

The Member States will now establish on their national territory a sanctions framework applicable to infringements by economic operators, as well as the establishment of specific rules for the design, construction, commissioning, operation and technical supervision of these installations.

In addition to the sanctions framework, it is now also necessary to identify the bodies responsible for enforcement, and the Instituto da Mobilidade e dos Transportes (Institute for Mobility and Transports) is given the power to authorise and monitor cableway installations.

It is the responsibility of the Instituto Português da Qualidade (Portuguese Institute for Quality), as the notifying entity, to notify the conformity assessment bodies, which must be previously accredited by it.

The Autoridade Tributária e Aduaneira (Tax and Customs Authority) is responsible for carrying out control at the external border of the safety components for cable construction and installation and, finally, the Autoridade de Segurança Alimentar e Económica (Authority for Food and Economic Safety) is in charge of market surveillance.

What advantages does it bring?

This decree-law allows the sharing of the transport of people with other modes of transport, which makes it possible to improve the mobility of the population, particularly in urban transport and support for tourism, and at the same time contribute to the development of land use planning, to safeguard the environment.

When does it enter into force?

This decree-law enters into force on 10 July 2020.
