What is it?

This decree-law establishes the mandatory declaration of felling, extraordinary felling, thinning or grubbing of forest species, hereinafter referred to as felling manifest (MCA).

What is going to change?

A compulsory mechanism for the delivery of the MCA is established, through an electronic data platform, accessible on the website of the Instituto da Conservação da Natureza e das Florestas [Institute for Nature Conservation and Forests] (ICNF), which updates and adapts the previous model, namely as regards its contents and articulation with the information declared under other specific legal schemes, which will be treated in an integrated manner.

The following are covered by this obligation to declare:

    • Operators who carry out felling, extraordinary felling, thinning or grubbing of trees of forest species and who place timber on the national market for marketing and self-consumption for industrial transformation and other operators involved in the acquisition of the trees and the respective woody material;
    • Operators who transport, store and first process wood destined for industry and also export wood material.

The felling, extraordinary felling, thinning or grubbing of trees of forest species are exempt from MCA when they are exclusively for self-consumption, except in cases of self-consumption for industrial transformation or when the number of trees is less than or equal to 10.

Operators shall declare in advance to the ICNF, through the Felling Manifest Information System (SiCorte), the felling, extraordinary felling, thinning or grubbing of forest species trees. This obligation rests with the purchaser where it is the purchaser's responsibility to carry out felling, special felling, thinning or grubbing of the purchased timber.

Until SiCorte is implemented and commissioned, the MCA is done electronically, in a template form to be made available free of charge on the ICNF website.

What advantages does it bring?

This decree-law aims to simplify administrative procedures, complying with the Simplex+ measure "Communication + agile felling for industry".

It also intends to strengthen the monitoring and surveillance component, as well as the collection of fundamental information for the development of management processes and assessment of the sustainability of the forest heritage.

When does it enter into force?

This decree-law enters into force on 27 December 2020.
