Summary in plain english
This Decree-law lays down the rules to which the information procedure is subject in the field of technical rules on products and services of the information society.
What is going to change?The existing prior procedure is a tool for information, prevention and dialogue in the field of technical regulations concerning products and services of the information society in the European Union.
In this prior procedure, services or entities in the Member States will be obliged to notify their draft regulatory or administrative legislation on products and information society services containing technical rules to the European Commission, which will examine them in the light of EU legislation.
The Member States participate in the procedure with the Commission and may also submit their opinions on notified drafts.
The notification must be made through the Portuguese Institute for Quality, as the competent national body for notification in that procedure, using the email address made available for that purpose on its website:
- Receive and manage information concerning the notification of technical rules on information society products and services;
- Disseminate information on notifications made by other Member States;
- Communicate in a timely manner to the services or entities which have drawn up the draft technical rules, any opinions and observations issued by the European Commission or by other Member States.
The decree-law ensures that Member States, and in particular economic operators, are kept informed of new drafts containing technical rules, giving them the opportunity to participate in the procedure laid down, with the aim of avoiding the creation of barriers in the internal market by preventing them from being implemented.
When does it enter into force?This decree-law enters into force on the day following its publication.
