What is it?

This decree-law ensures the execution of the European legislation related to gas appliances on the market, regarding their control and supervision, therefore ensuring the protection of the users’ health and safety.

It also establishes the assessment mechanisms of the notified bodies and the competent entity for its notification, as well as the sanctions applicable in the case of noncompliance.

The notified body is a body recognized by a Member-State to carry out the conformity assessment of a product, according to the European legislation.

Regarding the European legislation, as “appliances” are deemed the ones which burn gaseous fuels, used for cooking, refrigeration, air conditioning, heating, production of hot water, lighting and washing, as well as the burners with a ventilator and heat generators to be equipped with these burners.

What is going to change?

The provision on the market and/or the put into service, by any economic operator, of gas appliances must comply with the requirements deemed as relevant for the user’s health and safety.

The Portuguese Institute of Quality (IPQ) is the national authority competent to monitor the execution of this decree-law’s rules.

The Portuguese Institute of Accreditation (IPAC), as a national accreditation body, is responsible for the control of the conformity assessment bodies.

The supervision of the application of this decree-law’s rules shall be carried out by the Economic and Food Safety Authority (ASAE), which must process the infraction processes.

What advantages does it bring?

This decree-law, by ensuring that the gas appliances on the market comply with the harmonized European rules for the design and production, guarantees the protection of the users’ health and safety.

When does it enter into force?

This decree-law enters into force on the day following its publication.
