What is it?

This decree-law establishes the legal scheme of the production of water for its reuse (ApR), obtained from the treatment of wastewater, as well as its correct use in order to promote the correct use and avoid harmful effects to the health and to the environment.

What is going to change?

This scheme is applied to the reuse, for non-drinkable purposes, of the water from the household, urban and industrial wastewater treatment facilities (ETAR), aimed for uses compatible with its quality, namely for irrigation, landscape, urban and industrial purposes.

The production and use of ApR are subject to the obtaining of a license

The ApR’s production and use licenses are valid for a maximum period of 10 years and they may be renewed.

Who is responsible for the issue of ApR’s production and use licenses?

The Agência Portuguesa do Ambiente, I.P. (APA - Portuguese Environmental Agency) is responsible for providing, annually, on its website, information regarding the licenses issued.

The production and use of ApR are subject to a prior risk assessment.

Who inspects and supervises the compliance with these rules?

This responsibility falls on:

    • the General-Inspection of Agriculture, Sea, Environment and Territorial Planning (IGAMAOT);
    • the Agência Portuguesa do Ambiente, I.P. (APA);
    • the health authorities;
    • the police authorities.

IGAMAOT initiates the infraction processes derived from the non-compliance with the legal scheme for the production and use of ApR.

What advantages does it bring?

It contributes to improve the environmental status.

It ensures the sustainable use of the hydric resources, allowing to reduce the natural water consumption.

It promotes the hygiene of public spaces treated with reused water and the safety on the consumption of agricultural products irrigated with reused water.

When does it enter into force?

This decree-law enters into force on the day following its publication.
