This decree-law amends the legal scheme of criminal identification.What is going to change?
The citizen or the company which needs to submit their criminal record certificate for the compliance with a legal obligation may electronically obtain the certificates needed when the access code to the information is valid.
They may also provide the code to the entity which requested the certificate.How to obtain the access to the information?
Through a registry certificate. Its issue occurs when, for instance, it is requested by a qualified entity (tax authority, for example) or when an access code to the criminal record or to the contumacious record is requested.Who can request the access code to the criminal or contumacious record?
- The interested party or a legal representative, in the case of natural persons; or
- The legal representative or a third party authorized by the first, in the case of legal persons.
The access code to the criminal or contumacious record is provided in certificates which certify the content of the registry at stake or the lack of registry, regarding its holder.
The access code may be freely used during the validity period to obtain new certificates by the applicant or by any entity to which it is provided.
The criminal record information included in the certificates obtained during the validity of the access code is always updated to the date in which they are issued.What advantages does it bring?
This decree-law modernizes the criminal identification services and introduces improvements in the access to the registry information by the citizens and companies.When does it enter into force?
This decree-law enters into force on 17 September 2019.
